THE JUDICIAL IMPARTIALITY

Abstract

This article analyzes essentially the implications of the law to a impartial judge, the types of impartiality: objective and subjective and their relation with the judicial independence. It also examines the beginning of the impartiality like a fundamental law and rector of the due process, also the consequences of the bias, not just on the judge nor the committed parts but for the entire judicial system. Lastly, exposing the impartiality within the different legislations.
