Abstract

"Continuous crimes" has, by disposition of Ecuadorian criminal law, a concrete impact with relationship to determining the com- putation of the prescription, without any other legal reference. Historically, it has served as a "wild card" to apply penalties for non-existent criminal offenses to the date of commission of an offense, stretching the time of commission, due to a supposed continuity, unity and escalation, or, to mention, without any practical significance, to crimes of successive tract (Clarifying that such a term is considered more as a modus operandi than as a form of self-execution, as has been defined by Tiedeman for the so-called economic crime). For this reason, it is questionable to invoke it as fundament of the application of the Comprehensive Criminal Code (with which emerges the criminal type of Mass Scam) for previous conduct, consummated under the effect of the criminal type of Scam (now repealed) and the express law that resolved the issue of the contest of infractions, in response to a few cases prior to the cessation of the activity, located in the temporary space of posteriority to the promulgation of the current Code (COIP). Doing so, violating warranty principles, could contravene a norm of care.
