The Right To Protection Of Personal Data: Brief Legal Analysis
Abstract
Our personal information is handled by several people, companies, banks and even public institutions, either because we have given our authorization for such management, or because the Law grants this power. However, on many occasions we don't know the reason why our personal data are in registers or files of third parties, since such management is done without our consent, making our privacy vulnerable, taking into account the progress of technology, in which its misuse, increasingly affects this violation. This article aims to guide the reader, the legal nature of the constitutional right to the protection of personal data, the different faculties that gives its owner and most importantly, the reason that justifies having a law to regulate the processing of data personal, because unfortunately in Ecuador, has not yet been established an effective and effective rule, which allows privacy of the citizen, for which the more time passes, more methods will continue to invent to violate the aforementioned constitutional law and our country as such cannot remain stuck in the classical legal institutions that are currently applied, which, although they are useful, are not enough in the face of the enormous apogee of the new information and communication technologies.
