Alternative and mixed sanctions as a criminal response to economic crimes
Abstract
The new Penal Code broadened the range of sanctions applicable to individuals, establishing two types: alternative sanctions and mixed sanctions, the latter left to the judge’s discretion based on the principle of proportionality. Economic crimes, which until now lacked intermediate solutions since the primary penalties imposed were imprisonment or fines, face this predominance of these
sanction types. Therefore, this research aims to reflect on which of the currently available sanctions would be most appropriate for acts that threaten the national economy. Consequently, to achieve this objective, the following theoretical methods will be employed:
legal theory, analysis and synthesis, and analytical exegetical interpretation. Empirical methods will include content analysis, which are fundamental pillars of legal research, while the primary technique will be note-taking. This will be a novel and current investigation taking place after the Cuban penal reform, which has provided legal professionals with different tools that, despite their
recognition, are not reflected in judicial practice.
