Abstract

The objective of this article is to demonstrate that the application of legitimate defense in Ecuador faces several challenges from different perspectives and contexts. It is regulated with requirements in the Comprehensive Organic Criminal Code of Ecuador; however,
the existence of these challenges gives rise to confusion in certain cases. The emerging challenges in the interpretation and application of this fundamental right in the country are analyzed, considering recent social and legal changes. A qualitative methodology was used, a survey was applied to 283 students and professionals in the legal field, to examine the doctrine and representative cases that reflect the current complexities around legitimate defense in Ecuador. Demonstrating the lack that clarifies the limits of the same. Finally, the results of a survey of citizens, students and professionals in the legal field are analyzed to know the citizen perception of legitimate defense in Ecuador. Most recognize the existence of these challenges and consider it necessary to reform the laws to clarify their limits and application.
