Enforcement of contemporary public international law: Special reference to the regime of countermeasures

Abstract

The ambiguities presented by the current legal regime of countermeasures make them an instrument that can be manipulated according to the political interests of the States, which facilitates the violation of the norms and principles of Public International Law (PIL) in the area of responsibility. of the State before the commission of an international illicit act. This study delves into the theoretical-legal foundations that support the countermeasures regime, such as the delimitation of their legal nature, the elements that characterize them and the functions they perform. In addition, it analyzes the substantive and procedural conditions; as well as the essential limits for its legitimate application.
