The Transit Of Legiscentrism To Neocostitutionalism And Its Influence On The Formulation Of The Guarantees Of Rights
Abstract
At the beginning of the founding of the Republic of Ecuador, the constitutional text was not considered as the center of the national legal order, because it was mentioned as a political document, but not a legal one. The Constitution, appreciated as a set of principles and rules, required the help of the application of the law so that its full validity is presented, thus presenting the law as the center of this order through the principle of parliamentary sovereignty, imported from the European continent. The influence of the French Civil Code means that the Constitution is not considered as a direct source of law, thus being explained in Art. 1 where reference is made to the fact that the law "is a declaration of the sovereign will, which, manifested in the form prescribed by the constitution, mandates, prohibits or permits." This constitutional text was considered as the supreme norm, but it was not established as a supreme legal norm, but as a declarative norm of principles and organizer of the structure of the State. The Second World War is mentioned as the main antecedent to present the great step to a "neoconstitutionalism", where the positivization of rights takes precedence and thus the Constitution begins to have supreme juridical normative force, and that with binding force, goes establishing a paradigm shift from legiscentrism to constitutionalism.
