Dogmatic analysis from the perspective of material equality and affirmative action of the Organic Law of Youth and the principle of equality in the Ecuadorian labor field

Abstract

This article develops a legal-dogmatic analysis of Ecuador’s Organic Law of Youth in relation to the constitutional principles of equality and non-discrimination within the labor sphere. The study examines whether the normative design of this law, in conjunction with the system of tax incentives established by the Organic Law on Economic Efficiency and Employment Generation, effectively enables the realization of substantive equality in access to youth employment or whether its impact remains predominantly formal. Through a doctrinal methodology, the research analyzes constitutional provisions, statutory law, tax regulations, and relevant jurisprudence of the Constitutional Court of Ecuador, assessing the internal coherence of the legal framework and the scope of the State’s obligations to guarantee fundamental labor rights. The findings reveal that, despite significant normative progress in recognizing youth as a group subject to structural disadvantage in the labor market, the absence of binding and enforceable legal mechanisms limits the material effectiveness of the principle of equality. The article concludes by emphasizing the need for a more robust and integrated normative approach to ensure dignified, stable, and non-discriminatory employment for young people.
