Between Subventions and Subsidies. A Critical Analysis of Agreement 9072/2021 of the Council of Ministers and its Complementary Regulations.
Abstract
In this paper, a critical analysis is carried out of Agreement 9072/2021 of the Council of Ministers and its complementary regulations, with the aim of assessing how the subsidies legally established therein are configured as administrative subventions from both a structural and functional perspective. To undertake this assessment, two essential tasks will be carried out. On the one hand, the essential components of both the subventional technique and the subsidy will be conceptually delimited, taking into account those
doctrinal ideas and contributions that remain almost invariant within the theoretical composition of each technique. On the other hand, once both figures have been delimited in their essential contours, an argument will be developed regarding the essentially subventional nature of the benefit regulated in the aforementioned regulations, referring to the features of each technique that can be identified in the studied norms, while also verifying another series of provisions whose content proves contradictory to both figures. In this way, it will be possible to verify not only a terminological confusion between subsidies and subventions but also a legal configuration which, although closer to the latter, contains several deficiencies that may prove contradictory to them.
